ABOUT LASTREGATTA.IT AND THE PRESENT CONDITIONS OF SALE.
These conditions are valid exclusively between the company LaStregatta.it with registered office in via Fratelli Rosselli 159a 40014 Crevalcore (BO) and any person who purchases online on the website www.lastregatta.it, by telephone or by e-mail, hereinafter referred to as ”CUSTOMER”.
These conditions may be subject to changes and the date of publication of the same on the site is equivalent to the date of entry into force.
These conditions govern purchases made on the website www.lastregatta.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree n. 206/2005, amended by Legislative Decree. n. 21/2014 and by Legislative Decree. 70/2003 on electronic commerce in addition to purchases made by telephone and by e-mail.
These Conditions of Sale apply to any order confirmed to LaStregatta.it according to the procedures indicated below.
Please note that you will be required to accept these Terms of Sale prior to placing an order for products. The non-acceptance of these Conditions of sale will make it impossible to order products, any changes may be made from time to time to these Conditions of sale; therefore please check them regularly to keep informed of updates.The latest version of these Conditions of Sale will always be available on the website www.lastregatta.it.
Any new version of these Terms of Sale will take effect immediately on the date of publication and will govern orders for products or services made from that date. Changes to the Conditions of Sale subsequent to the confirmation of the order will not affect the order or the relationship with us, except as may be required by applicable law.
OBJECT OF THE CONTRACT
With these general conditions of sale, LaStregatta.it sells and the CUSTOMER remotely purchases the movable tangible goods indicated and offered for sale on the website www.lastregatta.it.
The contract ends:
through the internet, by accessing and registering the CUSTOMER at www.lastregatta.it and the creation of a purchase order according to the procedure provided by the site itself and better specified in the order procedure section.
by sending an e-mail and making a purchase order according to the procedure provided in the order procedure section.The customer undertakes to read, before proceeding with the confirmation of his order, these general conditions of sale as well as the pre-contractual conditions provided by LaStregatta.it, which must be viewed and accepted before confirming the order by affixing a flag in the indicated box.
In the order confirmation e-mail, the CUSTOMER will also receive the link to download and archive a copy of these general conditions of sale, as required by art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.
PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER – ART. 49 OF Legislative Decree 206/2005
Before concluding the purchase contract, the CUSTOMER examines the characteristics of the goods that are illustrated in the individual product sheets.
Before validating the order with “payment obligation”, the CUSTOMER is informed about:
total price of the goods including taxes, with details of shipping costs where applicable and any other costs;
terms of payment;
conditions, terms and procedures for exercising the right of withdrawal (Article 6. of these conditions)
after-sales assistance conditions and commercial guarantees provided by LaStregatta.it.
4. ORDER PROCEDURES
The order procedure for online purchases through the website www.lastregatta.it includes the following:
- Registration on the site: in order to proceed with the purchase it will be necessary to fill in the “form” for registration before completing the order in order to provide all the necessary data. Especially the billing address. The possibility to register is also given at checkout.
- Add to cart: once you have chosen one or more products and selected the desired quantity, it will be possible to add the product (s) in the cart. You can subsequently decide to continue the purchase of other products and add them to the cart.
The CUSTOMER will therefore have the opportunity to view the cart where all the conditions of sale of the selected products are summarized. - Order, shipping and payment: after the choice, proceed with the “Order” which provides for the confirmation of the purchase in 4 steps:
- order summary: “You are already a customer”, if the CUSTOMER is already registered

Alternatively, the possibility is given to create a new account by entering the necessary data. - address: as part of the order process, you can add and review your order details and personal information (including email, shipping address, billing address and payment information ).
- shipments: the courier and the shipping cost, where present, is highlighted.
- payment: you can choose the payment methods (PayPal, Credit Card, Bank Transfer).
In the case of an order sent by sending an e-mail, you will receive an order confirmation e-mail with all the transaction data summarized.
We reserve the right, at our discretion, to refuse, cancel and terminate orders at any time for reasonable reasons. For example, we may refuse, terminate or cancel your order if there is an ongoing dispute over the payment of a previous order or if we suspect, in our sole discretion i) fraudulent activity; or any ii) violation of these Terms of Sale.
The sales contract is considered concluded with the sending by LaStregatta.it to the CUSTOMER of an order confirmation by e-mail or other suitable means. The e-mail contains the CUSTOMER data and the order number, the price of the purchased goods, any shipping costs and the delivery address to which the goods will be sent and the link to be able to print and archive the copy of these conditions.
The CUSTOMER undertakes to verify the correctness of the personal data contained in the above e-mail and to promptly notify LaStregatta.it of any corrections / changes to be made.
Confirmation of the order and shipment constitutes acceptance of the order by us and indicates the existence of a binding sales contract.
PRICES, TAXES AND SHIPPING COSTS
LaStregatta.it uses the Euro (€) as the only currency, the costs and prices of the products will be indicated in the cart before confirming the order.
Taxes on sales, use or any other taxes may vary depending on the location to which the products will be shipped.
Shipping costs will be added to the price of the product (s) and will be summarized before the request for confirmation and transmission of the order and also highlighted in the correspondence via e-mail.
POSSIBLE ERRORS AND / OR LACKS
It is always possible that, despite the reasonable efforts made by us, some products offered on our sales channels or delivery costs may report an incorrect price. If one of the products for which the order is sent or in the case of an error in the shipping costs, we will contact you as soon as possible to inform you of the error. If we are unable to contact you using the contact details provided during the order process, the order will be canceled by us by sending a written notification. In the event of incorrect acceptance and processing of the order received by us or errors on delivery costs, where applicable, we can cancel the delivery of the product and refund the amounts paid.
Please note that changes made to the law in force between the date of transmission of the order and the date of sending the Order Confirmation and shipment in writing may result in changes in the taxes associated with the order. 6. PAYMENTS
We accept the payment methods identified in the Order Process part. When ordering, you need to enter your payment details in the appropriate form.
The goods supplied by LaStregatta.it must be paid in one of the following ways: advance bank transfer, credit card, PayPal.

In the case of payment by bank transfer, the order will be activated as soon as it is visible on the current account of LaStregatta.it (maximum 5 working days).
It will be possible to speed up this procedure by sending a copy of the bank transfer receipt by e-mail to payments@lastregatta.it.
The CUSTOMER expressly authorizes LaStregatta.it to carry out security checks, if deemed necessary, to transmit or obtain information (including updated information) on the same customer or on third parties, for any reason, including, but not limited to, the data of the payment card, for identity authentication, for payment card validation, for obtaining an initial authorization for the payment card and for authorizing individual purchase transactions.
The total amount of the purchase will be charged to the payment card at the time of order confirmation.
Where we use PayPal as a payment method, the full amount of the purchase can be withdrawn immediately after the order is placed.
The prepayment does not affect your statutory rights under these Terms of Sale (including, for example, any right to reimbursement where applicable). If we are unable to meet the shipping and / or delivery obligations set out below, you will be notified by email and we will refund your prepayment without undue delay.
The application of commissions on bank transfers for orders sent may be envisaged, in which case any charge will be communicated in the order summary e-mail.
We ask for confirmation of all wire transfer orders sent by telephone through an order approval process. We may recognize a bank transfer order, however the order will not be processed until payment is received and confirmed by email. If the payment of the transfer is not credited to our bank account within five (5) days from the transmission of the order, it will be canceled.
POLICY AND METHOD OF SHIPPING AND DELIVERY
LaStregatta.it provides for the shipment of the ordered goods in the following ways:
Standard mode: the ordered goods are produced / shipped / delivered in a maximum of thirty (30) working days with effect from the conclusion of all the order procedures and upon payment.
Shipments are made by express courier under the following economic conditions:
Shipping: free for the purchase of products whose total is less than or equal to € 60.00.
Shipping: up to € 12 for the purchase of products whose total is less than or equal to € 59.99.If you need other clarifications, write us an email to info@lastregatta.it.
DELIVERY
We will do our best to ensure the delivery of the products within the delivery times established from the date of the Order Confirmation and shipment by us and in any case within a maximum of thirty (30) days from the aforementioned date in accordance with the law (Article 61 of Legislative Decree 206 of 6 September 2005 amended by Legislative Decree 41/2014), unless the purchase concerns a product or service for which prior notice has been received indicating longer delivery times, for example in the case of customized products or services or products according to customer specifications.
In case of delay in the delivery of the products due to an event beyond our control, the CUSTOMER will be informed in a reasonable time and we will do our best to minimize the effects of the delay. In case of non-receipt of the product within the maximum term of thirty (30) days (required by law) from the date of the Order Confirmation and shipment in writing or within any other time limit indicated by us, you can contact lastregatta.it to cancel the order and obtain a refund of any amount paid in advance for products not received.
Please note that delivery is always subject to receipt of full payment.
Once lastregatta.it has delivered the ordered product to the courier selected by the customer, the risks and responsibility for the goods purchased will be transferred to the customer in accordance with the provisions of art. 63 Legislative Decree 206/2005 amended by Legislative Decree 41/2014
In the case of specification of a different recipient indicated by the CUSTOMER for the purpose of delivery (in the case, for example, of a gift), it is understood and accepted that the proof of a signature of said recipient (or of a person at the address of address) constitutes proof of delivery, of the fulfillment of the sales contract by lastregatta.it.
BILLING
When ordering the products through the sales channels indicated above and in the manner specified, if requested, you will receive an invoice that will be sent in writing (to the e-mail address indicated as a PDF attachment or in another format).
RIGHT OF CANCELLATION RETURNS
You have the right to cancel the contract stipulated by written confirmation of the order without giving any reason within fourteen (14) days from the day of purchase. To meet the withdrawal deadline, it is sufficient to assert the right of withdrawal before the withdrawal period has expired.

RETURN PROCEDURE
Products purchased through the site www.lastregatta.it and not personalized can be returned if they are not in conformity, are incorrectly delivered or are delivered in a different number than those ordered.
To return a product you need to follow the steps below:
(i) any discrepancies in the product must be promptly communicated by sending an e-mail to resierimborsi@lastregatta.it.
(ii) For all returns, you must include in the return package, the product, together with all related accessories, any free items received as part of your order, other documents, possibly in their original box.
(iii) The return is made by sending all the material delivered to the laStregatta.it warehouse where we will verify that the returned product meets the conditions of the Return Policy and, in case of compliance, it will be possible to request reimbursement of the costs incurred. . Transport costs will be borne by laStregatta.it
You may be asked to provide product information to make an initial assessment of the condition of the product.
LaStregatta.it reserves the right not to accept returns if the product shows signs of wear or has been used or altered from its original condition in any way.
If the order included free items, these must be returned with the products.
Any return will be subject to rigorous Quality Controls (“QC”), carried out by us to ensure the compliance of the returned products with these requirements. If the products do not meet QC standards, the return will not be accepted and the products will be returned to you. If the returned product meets the QC, we will proceed with the refund.
Failure to comply with these Conditions of Sale will authorize us to refuse the returned product and to return it at your expense.
NON-RETURNABLE PRODUCTS
Orders for products customized in any way or made differently from specifications cannot be canceled and such products cannot be returned for refunds.
REFUNDS
It is possible to return a product purchased through the website www.lastregatta.it for the purpose of reimbursement, provided that the return complies with these Conditions of Sale, in particular with the Right to Cancellation and the Return Procedure referred to above.
Only the buyer will be entitled to receive a refund of the price paid. Under no circumstances is a person who received the product as a gift (ie the “gift recipient”) entitled to a refund.

However, we make no warranties, express or implied, with respect to the accuracy, reliability and completeness of this information.
LIMITATIONS OF LIABILITY
Nothing in these Terms of Sale limits or excludes our liability for any other liability that cannot be excluded or limited under applicable law. Without prejudice to the provisions of the previous sentence, LaStregatta.it will not be liable for damages and consequences deriving from / or relating to / inappropriate or unauthorized use of the site or its content.
LaStregatta.it disclaims any responsibility for the topicality, accuracy, truthfulness, completeness or quality of the information provided by the CUSTOMER.
Any liability towards LaStregatta.it is excluded in relation to damage of a material or immaterial nature, caused by the use or non-use of the information provided therein or by the use of incorrect and incomplete information, except in the case in which it is demonstrable that the author has acted intentionally or with gross negligence.The obligations assumed (obligations of the buyer) as well as the guarantee of the successful completion of the payment that the CUSTOMER will make (prices and payments), are essential, so that by express agreement, the non-fulfillment of only one of these obligations will determine the resolution of right of the contract, without prejudice to the right for LaStregatta.it to take legal action for compensation for further damages.
GENERAL PROVISIONS
If any provision or part of a provision of these Terms of Sale is found to be illegal, invalid or unenforceable, such provision or part of provision will not be considered part of these Terms of Sale and the legality, validity or enforceability of the remaining part the provision referred to in these Terms of Sale is not affected, unless otherwise required by applicable law.
These Conditions of Sale (and the terms associated with them) constitute the entire agreement between the CUSTOMER and LaStregatta.it in relation to the order of the products and replace and invalidate any agreement, draft agreement, provision, deed or contract of guarantee. previously stipulated, of any nature, between the parties, both in oral and written form, in relation to the aforementioned matter.Under these Terms of Sale, we are not responsible for any errors or delays in the execution or fulfillment of obligations arising from causes beyond our reasonable control.

No other person will have the right to enforce any of the terms of the aforementioned contract.
GOVERNING LAW AND JURISDICTION
These Conditions of Sale are governed and interpreted in accordance with the laws of the country in which LaStregatta.it has its registered office, Italy, without reference to provisions on conflict of laws (“applicable laws”).
Where applicable laws differ from the mandatory consumer protection regulations of the country of residence, similar protection will be guaranteed by us.
Except for mandatory legal provisions, in the event that disputes arise regarding these general conditions, the competent court will be that of the Court of Bologna where LaStregatta.it has its registered office.
